Commercial Litigation Group We defend governmental entities, private companies, and individuals against civil rights actions based on alleged violations of constitutional rights, federal law or state statutes. Our attorneys have successfully defended clients against claims based on alleged political retaliation, excessive force, false arrest, malicious prosecution, sexual harassment, sexual discrimination, and disability discrimination. We have been appointed as Special Cook County State’s Attorneys to defend the Cook County Sheriff and its employees, and also represent the City of Chicago, Chicago Police Department, and local municipalities and their employees. In our representations, we have:
  • Prevailed in a jury trial on all issues in the representation of the City of Chicago against Section 1983 and all other claims made by plaintiffs in connection with a search of an apartment and the arrest of suspects.
  • Defended companies affiliated with Hitachi, Ltd. in a case alleging racial discrimination in violation of California law. The case was tried before a jury in Orange County, California and we prevailed on behalf of Hitachi.
  • Defended the Cook County Sheriff in a Section 1983 action based upon the alleged failure to provide mental health treatment to inmates at Cook County jail. The matter was brought as a class action and the plaintiffs demand was $30 million. We defeated class certification and after extensive discovery the matter was settled for less than $50,000.
  • Represented a Cook County Sheriff lieutenant who allegedly conspired with high level officials in the CCSO to retaliate against an employee who claimed to be a whistleblower. After extensive discovery, our client was dismissed from the action.
  • Defended the City of Chicago where a plaintiff alleged that a CPD Sergeant used his taser to injure a child. During discovery, a far different factual scenario was proven, and the City and all defendants were dismissed.
